These Terms govern use of binauralbeatmachine.com (the “Site”), the free binaural console, optional paid subscription, and digital products sold through our store. By using the Site or purchasing a product, you agree to these Terms.

1. Who we are

2. Free console

The core binaural frequency console is free to use in a modern web browser. Headphones are required for the binaural effect. No purchase is required for free console features.

3. Accounts & subscription

• Optional free Subscriber and paid Member plans may unlock additional content (for example GUIDE, DRUM, guided libraries).
• Paid plans bill via Stripe (or another processor we designate). You authorize recurring charges until you cancel.
• You must provide accurate account email information and keep your password secure.
• Cancellation and refunds are described in the Return & refund policy.

4. Digital store products

• Software, plugins, and audio downloads are licensed for personal use by the purchaser unless a product page states otherwise.
• You may not redistribute, resell, publicly rehost, or share license keys or paid download files.
• Checkout and file delivery for many products are handled by Gumroad; their terms also apply to that checkout session.
• Delivery is electronic only — see Shipping & delivery policy.

5. Acceptable use

You agree not to:

• Abuse, reverse-engineer, or overload the Site or APIs in a way that harms other users or our infrastructure.
• Use the service for unlawful purposes.
• Misrepresent affiliation with Binaural Beat Machine.
• Circumvent paywalls or share paid Member access with the public.

6. Wellness disclaimer (important)

Binaural Beat Machine provides audio tools for wellness, practice, focus, and creative listening. It is not a medical device, not clinical treatment, and not a substitute for professional medical or mental-health care. Do not use while driving or in situations that require full attention. Keep volume at comfortable levels. If you have a neurological condition, consult a qualified professional before use.

7. Intellectual property

Site design, software, branding, and original content are owned by Binaural Beat Machine or its licensors. Free programs may be used for personal listening. Commercial redistribution of recordings or software requires a purchase/license covering that use.

8. Third-party services

Payments, email delivery, hosting, and downloads may involve Stripe, Gumroad, Netlify, Supabase, or similar providers. Those services process data under their own policies. See our Privacy Policy.

9. Disclaimer of warranties

The Site and products are provided “as is” to the fullest extent permitted by law. We do not warrant uninterrupted availability or fitness for a particular purpose beyond what is stated on product pages.

10. Limitation of liability

To the fullest extent permitted by law, Binaural Beat Machine is not liable for indirect, incidental, or consequential damages arising from use of the Site or products. Our aggregate liability for a paid purchase is limited to the amount you paid for that purchase in the prior 12 months.

11. Changes

We may update these Terms by posting a new version on this page with an updated date. Continued use after changes constitutes acceptance of the revised Terms for future use.
